25. GOVERNING LAW AND JURISDICTION
25.1 Applicable Law
These Terms and Conditions, and the relationship between you and Emerald Support Welcome Centre CLG, shall be governed by and construed in accordance with the **laws of the Republic of Ireland**.
This Includes:
- Irish contract law
- Irish consumer protection legislation
- Irish Sale of Goods and Supply of Services Act 1980
- Irish Data Protection Act 2018
- All applicable EU Regulations and Directives (including GDPR, Consumer Rights Directive)
What "Governed by Irish Law" Means:
- Irish law interprets these terms
- Irish law fills any gaps in these terms
- Irish legal principles determine validity and enforceability
- Irish consumer protections apply
- EU law applies as incorporated into Irish law
25.2 Jurisdiction and Court Location
Exclusive Jurisdiction:
Both you and Emerald Welcome Centre agree to submit to the **exclusive jurisdiction of the Courts of Ireland** for resolution of any disputes arising from these Terms and Conditions.

25.3 EU Consumer Rights - Alternative Jurisdiction
Special Rights for EU Consumers:
If you are a consumer residing in the European Union, you have additional rights under EU consumer protection law:

- In the courts of the EU country where you live
- Under the consumer protection laws of your country
- Without waiving protections provided by mandatory consumer law
Example:
If you live in Germany and have a dispute with us:
- You can sue us in Irish courts (our location), OR
- You can sue us in German courts (your location), OR

Your choice of jurisdiction does not reduce your consumer rights under EU law.

- Remaining provisions remain valid and enforceable
- The severed provision is replaced with a valid provision closest to the original intent
- This applies only in jurisdictions where the provision is invalid

- If a term violates mandatory Irish consumer law, it is void in Ireland
- If a term violates mandatory EU consumer law, it is void for EU consumers
- Valid terms remain enforceable to maximum extent permitted by law
